The Building Code Act’s applicable statutory requirements, which must be followed in order to be eligible for a building permit, prominently include zoning compliance. As a result, issues with Certificate of Occupancy compliance are more likely to occur when neither a building permit nor one was required or obtained.

The term “Occupancy Permits” may occasionally be used interchangeably with “Certificates of Occupancy” by municipal officials or some real estate attorneys who are not familiar with the distinction. They may also be known as Change of Use Certificates or included in the municipality’s Zoning Certificate process, which demonstrates the plan’s compliance with the bylaw established in accordance with this section and other zoning regulations.
